Turkey Hill Nation is a network connecting Turkey Hill Dairy and its many loyal customers. Turkey Hill Nation allows interactions between Turkey Hill Dairy and the Members of Turkey Hill Nation, as well as interactions between the Members.

DOWNLOADING, INSTALLING, ACCESSING OR USING THIS TURKEY HILL NATION MOBILE APPLICATION (THE "APPLICATION") OR TURKEYHILLNATION.COM (THE "WEBSITE") CONSTITUTES ACCEPTANCE OF THESE TERMS OF USE ("TERMS"), AS SUCH MAY BE REVISED BY TURKEY HILL DAIRY FROM TIME TO TIME, AND IS A BINDING AGREEMENT BETWEEN THE USER ("USER") AND TURKEY HILL DAIRY GOVERNING THE USE OF THE APPLICATION OR THE WEBSITE. Turkey Hill Dairy failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms. Turkey Hill Dairy requests that Users not use the Website while driving.

Indemnification

The User agrees to defend, indemnify, and hold harmless Turkey Hill Dairy, its parent, subsidiary and other affiliated companies, independent contractors, service providers and consultants, and their respective employees, contractors, agents, officers, and directors from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, and expenses (including attorney's fees) that arise from or relate to the User's use or misuse of the Website, violation of these Terms, or violation of any rights of a third party. Turkey Hill Dairy reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate in asserting any available defenses. In the event of any third party claim that the Website or User's possession and use of the Website infringes that third party's intellectual property right, Turkey Hill Dairy will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Warranties; Disclaimers

TURKEY HILL DAIRY IS PROVIDING THE APPLICATION AND WEBSITE TO THE USER "AS IS" AND THE USER IS USING THE APPLICATION AND WEBSITE AT HIS OR HER OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, TURKEY HILL DAIRY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES THAT THE APPLICATION AND WEBSITE IS MERCHANTABLE, RELIABLE, AVAILABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, NON-INFRINGING, FREE OF DEFECTS OR VIRUSES, ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, THAT THE USE OF THE APPLICATION AND WEBSITE BY THE USER IS IN COMPLIANCE WITH LAWS APPLICABLE TO THE USER, THAT USER INFORMATION TRANSMITTED IN CONNECTION WITH THE APPLICATION AND WEBSITE WILL BE SUCCESSFULLY, ACCURATELY, OR SECURELY TRANSMITTED OR RECEIVED.

No Liability

TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL TURKEY HILL DAIRY (A) BE LIABLE TO THE USER WITH RESPECT TO USE OF THE APPLICATION OR WEBSITE, INCLUDING WITHOUT LIMITATION PARTICIPATION; AND (B) BE LIABLE TO THE USER FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF USER INFORMATION, THE INABILITY TO USE THE APPLICATION OR ANY OF ITS FEATURES OR DEVICE FAILURE OR MALFUNCTION.
